Terms of service

The terms that apply to our website, the Callibee app and our services. Callibee works with businesses only.

1. Scope

These terms apply to callibee.com, app.callibee.com and the services provided by Callibee, a company operating in Türkiye and the Netherlands.

If you have signed an order form or service agreement with us, the documents apply in this order if they conflict:

  • The order form or service agreement
  • The data processing agreement
  • These terms
  • The privacy policy

Your own general terms and conditions do not apply unless we have accepted them in writing.

2. For businesses only

Callibee is for businesses, not consumers. By using the website, the app or the services, you confirm that you act for a business and that you have the authority to bind it to these terms.

3. The services

Callibee designs, configures and runs AI call workflows and related products, including AI Call Center, Customer Support 360° and QA Engine. Scope, volumes, languages, integrations and fees are set out in the proposal or order form.

We may improve the services over time. During the term of an ordered service, we will not reduce its core functionality without notice.

Information on the website is general. It is not an offer, and it is not legal, medical, financial or compliance advice.

4. Accounts

You are responsible for the users you invite, for keeping credentials safe and for activity under your accounts. If you suspect unauthorised access, tell us straight away at info@callibee.com.

5. Calls and messages

You decide who is called or messaged, why, and with what content. As the customer, you are responsible for the following:

  • Having a legal basis under the KVKK or GDPR for contacting people, and giving them the privacy information the law requires.
  • Having consent for commercial calls and messages where it is required. In Türkiye this means Law No. 6563 and its regulation, including İYS registration and checks. In the Netherlands and the EU it means national telemarketing rules such as the Dutch Bel-me-niet register.
  • Respecting opt-outs and do-not-call requests, permitted calling hours and frequency limits.
  • Recording and AI disclosures where the law requires them, including under the EU AI Act.
  • The accuracy of the contact and case data you provide, and your right to share it with us.
  • Decisions you take based on call outcomes.

We help you configure workflows correctly, but we do not give legal advice.

6. Acceptable use

You may not use the services to:

  • Make unlawful, deceptive or harassing calls, or call emergency services.
  • Impersonate a real person or clone a voice without documented consent.
  • Collect card details by voice, or collect special-category data without an agreed lawful basis.
  • Send spam.
  • Gain unauthorised access, run security tests without our written permission, or disrupt the services.
  • Reverse engineer, copy or resell the services.

We may suspend a workflow or an account without prior notice when this is needed to stop a serious breach or to comply with the law. We will explain why and work with you to resume service.

7. AI output

AI output can be incomplete or wrong. You review and approve workflows before they go live, and you decide which cases must always go to a person. Summaries, scores and suggestions are aids, and you should check them where they matter.

8. Data

You keep your rights to your customer data, which includes your data and the recordings, transcripts and results created for you.

We process it as your processor under the data processing agreement, and only to provide and support the services.

We may use aggregated or de-identified usage information that identifies no one to operate, secure and improve the services.

We do not use your customer data to train models offered to other customers without your written permission.

9. Intellectual property

Callibee and its licensors keep all rights in the platform, software, models, templates, documentation and brand. During the term, you receive a non-exclusive, non-transferable right to use them as part of the services.

We may use any feedback you give us freely.

10. Fees

Fees are set out in the proposal or order form and exclude VAT and other taxes. Invoices are payable within 30 days unless we agree otherwise. If an invoice is unpaid after a written reminder, statutory commercial interest applies and, after notice, we may suspend the services until payment.

11. Confidentiality

Each party keeps the other's non-public information confidential and uses it only for the purpose of the services. This does not apply to information that is public through no fault of the recipient, was already known to it, was received lawfully from a third party, or must be disclosed by law.

12. Third parties

The services depend on third parties such as telephone carriers, SMS providers and your own connected systems (for example a CRM). We are not responsible for their availability, or for content you control. Their own terms may apply.

13. Availability

We make reasonable efforts to keep the services available and announce planned maintenance where possible. Service levels apply only if the order form includes them.

14. Warranties

We provide the services with reasonable care and skill. Otherwise the services are provided as is, to the extent the law permits.

15. Liability

Our total liability in any 12-month period is limited to the fees you paid in the 12 months before the event. For free use of the website, it is limited to EUR 100.

Neither party is liable for indirect or consequential loss, including lost profit, lost revenue, data that can be restored from backups, or damage to reputation.

These limits do not apply to intent or deliberate recklessness of a party's management, or to liability that cannot be limited by law.

16. Indemnity

You compensate Callibee for claims from third parties or authorities that arise from calls or messages made on your instructions without the required legal basis, consent or disclosures, or from data or content you provided without having the right to do so.

17. Term and termination

The term is set in the order form. Either party may terminate for a material breach by the other that is not remedied within 30 days of written notice, or if the other becomes insolvent. At the end of the term, data is deleted or returned as set out in the data processing agreement.

18. Changes to these terms

We publish changes on this page. For material changes we give at least 30 days' notice, and you may end the affected service before the change takes effect.

19. Governing law and courts

These terms are governed by the laws of the Republic of Türkiye. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. The İstanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction, unless the order form says otherwise.
